Terms of Use

These terms apply to this website, the request form, the committee page, and the screens and devices provided through it (together, "the service"). The service is provided by Duncan Singh Sachdeva ("I", "me"). By using the service, sending a request, signing in, or accepting a screen, you agree to these terms. If you don't agree, please don't use it.

1. What this is

The service is seva: a free service that shows the daily Hukamnama from Sri Harmandir Sahib on a Gurdwara's TV, with features such as announcements. A small device behind the TV is connected to my server, which sends it the Hukamnama, its settings and its software updates. There is no fee for the service. A Gurdwara (or a sponsor) pays only for the equipment, at store prices, and shipping, unless I've offered the device at no cost.

2. No guarantees

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted operation. In particular, I don't promise that:

• the Hukamnama will appear at a particular time, or every day;
• the text, translations or transliteration are free of errors;
• the screen, the device, the live kirtan or the website will always work.

3. Content from others

Much of what the service shows comes from others, and I am not responsible for it:

• Gurbani, translations and transliteration come from third-party sources, including BaniDB and GurbaniNow, and are checked against the Hukamnama published by SGPC and SikhNet. They are shown as received; I don't edit them.
• Live kirtan, where enabled, is a stream provided by its owner and is played directly from them.
• Announcements and other content added by a Gurdwara's committee are the responsibility of that Gurdwara and the person who posted them.

4. Committee members and Gurdwara content

If you manage a Gurdwara's screens:

• You confirm you are authorised by the Gurdwara to do so.
• You are responsible for everything you post, and for having the right to post it.
• You won't post anything unlawful, defamatory, hateful, political campaigning, commercial advertising, or anything that infringes someone else's rights, or anything disrespectful to Gurbani or the Gurdwara.
• Keep your sign-in to yourself; you are responsible for activity under it. Tell me through the contact form if you think someone else has used it.
• I may edit or remove any content, and suspend any account or screen, at any time and without notice, if I believe it breaks these terms or could cause harm.

5. Devices

• A device belongs to the Gurdwara once delivered. The Gurdwara is responsible for placing, powering and using it safely, for the TV it is connected to, and for its Wi-Fi network.
• I don't supply replacement equipment or repairs. Help is remote, as I'm able to give it.
• Software updates are sent to the device from my server automatically. Don't modify, copy or reinstall the device's software.

6. The software and website are mine

The software (on the server and on the devices), the website, its designs and artwork are owned by me and protected by copyright. All rights are reserved. Gurdwaras with a device may use the software as installed, for its purpose, while I provide it. You may not copy, modify, sell, host or reuse any part of it elsewhere. Gurbani, translations, fonts and other third-party material keep their own terms.

7. Changes, pauses and ending

I may change, pause or stop any part of the service, or these terms, at any time. If the terms change, the new version applies from its effective date; continuing to use the service means you accept it. Where I'm able to, I'll let Gurdwaras with a screen know about important changes.

8. Limitation of liability

To the fullest extent the law allows, I am not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, property, revenue or goodwill, arising from or related to the service, the devices or any content, however caused. My total liability for any claim related to the service is limited to the amount you paid me for the service in the twelve months before the claim, which for a free service is zero.

9. Indemnity (you hold me harmless)

To the fullest extent the law allows, you agree to defend, indemnify and hold me harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from or related to your use of the service or the devices, content you or your Gurdwara post, your breach of these terms, or your violation of any law or anyone's rights.

10. Privacy

How information is handled is described in the Privacy Notice.

11. Law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

12. Everything else

If any part of these terms is found unenforceable, the rest still applies. My not enforcing a part of these terms is not a waiver of it. These terms (with the Privacy Notice and, for Gurdwaras with a screen, the Screen Agreement) are the whole agreement about the service.
